  1. Role of Tek Ino

Tek Ino generally acts as a data processor on behalf of its business customers (“Business Users”).

Business Users act as data controllers and are responsible for:

  • Determining the purpose and legal basis of data processing
  • Obtaining required consents from end users
  • Providing transparency notices to their customers
  • Ensuring compliance with applicable laws and platform terms
  • Responding to data subject rights requests

Tek Ino processes personal data in accordance with documented instructions from Business Users and as otherwise permitted under applicable law, and does not independently determine the purposes of processing end-user messaging data, except where Tek Ino acts as a data controller as described in this Privacy Policy.

In limited cases (such as website visitor data or direct business contact data), Tek Ino may act as a data controller.

  1. Categories of Data Processed

Depending on service usage, Tek Ino may process the following categories of data:

A. Business Account Data

  • Company name
  • Contact person name
  • Email address
  • Phone number
  • Billing information
  • Account credentials

B. Messaging and Communication Data

When our platform is used in connection with messaging services (including the WhatsApp Business Platform), we may process:

  • Business profile information
  • Template message content

Such data is processed to deliver and support the requested messaging services on behalf of the Business User, in accordance with this Privacy Policy.

Tek Ino processes WhatsApp-related personal data only as necessary to provide, secure, maintain, and improve the services in accordance with the documented instructions of the Business User and applicable platform terms.

  • Log data
  • System configuration data
  • API request logs
  • Security monitoring data

This data is processed for service operation, system security, fraud prevention, troubleshooting, and performance optimization.

D. Website Data

When visiting our website, we may collect:

  1. WhatsApp Business Platform Data

When Tek Ino’s services are used in connection with the WhatsApp Business Platform:

  • Message content and related personal data are processed on behalf of the respective Business User in accordance with documented instructions and applicable service agreements.
  • Tek Ino does not independently determine the purposes of processing such end-user messaging data, except where required for security, compliance, or as otherwise permitted under applicable law.
  • Tek Ino may use data derived from such processing to operate, develop, and improve its services and underlying technologies, including to improve overall service performance and functionality, provided such processing remains consistent with applicable platform terms and data protection laws.
  • Tek Ino does not sell personal data or use personal data for unrelated third-party marketing purposes.

Meta Platforms, Inc. and its affiliates act as independent data controllers for certain processing activities carried out via the WhatsApp Business Platform in accordance with their own privacy policies and terms.

Business Users remain responsible for compliance with:

  • WhatsApp Business Platform Terms
  • Meta Platform Terms
  • Applicable data protection laws
  1. AI Processing and Model Usage

Where AI-based features are used, Tek Ino may process personal data and data derived from service usage as necessary to provide, operate, maintain, secure, improve, and develop its services, including AI-based functionality, in accordance with applicable law and contractual obligations.

Tek Ino does not sell personal data or use personal data for unrelated third-party marketing purposes.

Where third-party AI providers are engaged, they act as sub-processors subject to appropriate contractual safeguards.

  1. Sensitive Personal Data

Tek Ino does not independently determine the processing of specific personal data as defined under applicable data protection laws.

Where Business Users process specific personal data through the services, Tek Ino processes such data solely in accordance with the documented instructions of the relevant Business User.

Business Users remain responsible for ensuring that any processing of specific personal data complies with applicable laws, including obtaining any required consents and providing appropriate notices.

  1. Legal Basis of Processing

Where Tek Ino acts as a data controller, processing is carried out on one or more of the following legal bases:

  • Performance of a contract with the Business User
  • Compliance with legal obligations
  • Legitimate interests in providing secure and reliable services
  • Consent obtained by the Business User from its end users, where required
  1. Data Sharing

Personal data may be shared with:

  • Hosting and cloud infrastructure providers
  • Communication platform providers (including Meta Platforms, Inc.)
  • Security and monitoring service providers
  • Payment processing providers (if applicable)

All third-party service providers are contractually bound to process data only for service provision purposes and subject to confidentiality and data protection obligations.

Tek Ino does not sell personal data.

  1. Cross-Border Data Transfers

Data may be transferred to and processed in jurisdictions outside Indonesia where necessary for service provision.

Where such transfers occur, Tek Ino implements appropriate safeguards in accordance with applicable data protection laws, including:

  • Contractual data protection clauses
  • Vendor data processing agreements

Tek Ino ensures that transferred personal data is subject to a level of protection consistent with applicable data protection laws.

Upon termination of services, data is deleted in accordance with contractual terms and applicable law, unless legal retention obligations apply.

Backup data is removed in accordance with standard backup rotation cycles.

  1. Data Subject Rights

Where Tek Ino acts as a data processor, end users must direct their requests (including access, correction, deletion, restriction, or objection) to the relevant Business User acting as data controller.

Tek Ino will assist Business Users in fulfilling such requests where required by law.

  1. Data Security

Tek Ino implements appropriate technical and organizational measures to protect personal data against unauthorized access, loss, misuse, alteration, or disclosure, in accordance with applicable law.

Access to personal data is limited to authorized personnel with a legitimate business need.

  1. Data Breach Notification

Tek Ino will notify the affected Business User without undue delay after becoming aware of a confirmed personal data breach affecting the Business User’s personal data processed by Tek Ino or its authorized sub-processors in connection with the provision of the services.

Business Users remain responsible for any required regulatory or end-user notifications where Tek Ino acts as data processor.

  1. Data Deletion and Account Termination

Business Users may request deletion of their account and associated personal data by contacting contact@tek-ino.com.

Upon verified request:

  • Account access will be disabled
  • Stored messaging and related personal data will be deleted in accordance with contractual terms and applicable law
  • Backup data will be removed according to standard retention cycles

End users must direct deletion requests to the relevant Business User acting as data controller.

  1. Processing of Minors’ Data

Tek Ino does not provide services directly to individuals, including minors.

Where Business Users communicate with individuals under 18 years of age using the services, the Business User remains responsible for:

  • Determining lawful basis for processing
  • Obtaining required parental or guardian consent
  • Providing appropriate notices

Tek Ino processes such data solely under the instructions of the Business User.

  1. Data Processing Agreement

Where required by applicable law, Tek Ino will enter into a separate Data Processing Agreement (DPA) with Business Users governing the processing of personal data.

  1. Changes to This Policy

Tek Ino may update this Privacy Policy from time to time. Updates will be published on our website with a revised effective date.
